Delta-Sonic Car Wash Agrees to Settle Wage Pay Case for $800,000
Delta-Sonic Car Wash will pay $800,000 to a class of more than 13,000 current and former car wash employees who claim Delta-Sonic paid them below the minimum wage rate by failing to notify them that they would receive a tip credit to raise their wages up to the minimum. Delta-Sonic, which operates 29 car wash facilities in New York, Pennsylvania, and Illinois, has agreed to pay employees working under the title of “Delta Technician” a range of $7.50 to $127.50, based on the number of weeks the employee worked for Delta-Sonic during the relevant time period. The “Delta Technician” job tasks include cleaning and detailing the interior and exterior of vehicles, power-washing vehicles prior to entering the car wash, and drying vehicles exiting the car wash. These employees had the ability to earn tips based on customer satisfaction and allege that Delta-Sonic purposefully failed to notify them of the tip allowance they claimed on employees’ wage records. The employees also allege that Delta-Sonic made employees wear jackets with the Delta-Sonic logo, yet required them to pay for their own uniform laundering in violation of state law. According to the lawsuit, the nature of the job and close proximity to dirty vehicles resulted in the routine soiling and staining of employees’ uniforms, entitling the employees to reimbursements in the range of $4.25 to $8.90 per week based on the number of hours worked in a given week.
