Overtime Wage Lawsuit for Citibank Staffing Agency Workers Settles for $1.08 Million

A class action lawsuit for overtime violations filed against Citibank and its staffing agencies has been settled for $1.08 Million. The lawsuit alleged Citibank and two staffing agencies failed to pay clerical workers overtime in violation of the Fair Labor Standards Act (“FLSA”) and New York Labor Law (“NYLL”). The workers were placed as clerical workers through Open Systems Technologies and Princeton Information Staffing Agencies to help implement anti-money laundering controls at Citibank affiliates.

The workers were assigned by the staffing agencies to perform work at the affiliates as Know Your Customer (“KYC”) Analysts. The workers allege that they were not paid overtime by the companies for more than 40 hours worked in a workweek even though they were non-exempt hourly employees. Although Citibank denied all the allegations in the lawsuit, attorneys for the workers reached the $1.08 Million settlement after months of negotiations. Eligible class members of the lawsuit will receive an average net settlement payment of $17,720.
