The Department of Labor obtained a federal court judgment requiring 15 gas stations–operating under brands such as BP, Mobil and Sunoco– in Bronx, Nassau, and Suffolk counties to pay more than $1 million in back wages and liquidated damages to more than 100 current and former employees.
The Department of Labor filed a lawsuit in March 2022 after it found that the owner of the gas stations, Jagjit Singh, failed to pay employees overtime, paid some employees less than the $7.25 per hour federal minimum wage, and did not keep wage records at required by the Fair Labor Standards Act from 2015 through 2018.
David An, the Wage and Hour Division District Director for the Department of Labor, said, “Jagjit Sigh willfully denied over one hundred employees their hard-earned wages. The back wages recovered, and damages and penalties assessed, send a clear signal to all employers that intentionally defying federal law will have costly consequences.”
Under the Fair Labor Standards Act and New York Labor Law, most employees must be paid the minimum wage, and one and one-half times their hourly wage rate for all hours worked over forty per workweek.
