The Fair Labor Standards Act has been on the books since 1938, but only recently have workers been actively pursuing their right to minimum wage and overtime pay. Overtime and minimum wage lawsuits have surged in recent years, and currently comprise approximately 10% of the federal court docket in New York and that number is rising.
