Federal Court Grants Final Approval of a $1.8 Million Settlement for Cleaning Workers at Montefiore Facilities

CSS, a facilities management company, has settled a wage and hour class action filed by current and former cleaning workers who worked at Montefiore facilities in New York.

The cleaning workers, many contracted to work during the Covid-19 pandemic, alleged that they were required to work over forty hours per week at Montefiore’s Hutchinson Campus, Albert Einstein Campus, and other facilities across New York, but did not receive overtime pay and were not paid each week, as required by New York Labor Law.

The Settlement approved by the Federal Court in the Southern District of New York allows approximately 170 cleaning workers to receive their unpaid overtime pay and other damages for work performed from 2016 to 2022.

Under the Fair Labor Standards Act and the New York Labor Law, cleaning workers should have been paid overtime at one and a half times their regular pay rate for hours worked over 40 each week. For example, a cleaning worker paid the New York minimum wage of $16.00 per hour should be paid $24.00 for all hours worked over 40 in a week.
