New Jersey Recycling Corporation Sued by Workers for Overtime Pay

Pechman Law Group has filed a wage payment lawsuit against GDB International, Inc. (GDB International), a New Jersey corporation specializing in the processing of recycled materials, for failing to pay minimum wage and overtime pay to warehouse workers at two New Jersey facilities.

GDB International operates recycling facilities in New Jersey, Illinois, and Ohio. GDB International‘s two New Jersey locations are located at 461 Ridge Rd, Monmouth Junction, New Jersey 08852, and 1 Home News Row, New Brunswick, NJ 08901. Workers at these two New Jersey facilities would sort through recycled materials, disassemble recycled appliances, operate machinery, and prepare processed materials for shipping. The Complaint claims that throughout their employment with GDB International, the plaintiffs and other warehouse workers were paid the same hourly rate for all hours worked in a week despite regularly working as many as sixty-eight hours a week. Additionally, the Complaint alleges that GDB International’s wage payments fell below New Jersey’s minimum wage at times.

Under the Fair Labor Standards Act (FLSA) and the New Jersey Wage and Hour Law (NJWHL), warehouse workers should be paid at least the prevailing minimum wage and should receive overtime pay of one and a half times their regular rate for hours worked over 40 each week. For example, for a warehouse worker paid at the New Jersey minimum wage of $12.00 per hour, all hours worked over 40 in a week should be paid at $18.00. The plaintiffs and other warehouse workers were entitled to adequate minimum wages and overtime pay under the FLSA and the NJWHL and can seek to recover those wages in addition to liquidated damages, interest, and attorneys fees and costs.
